DMCA Copyright Claims

Mixgens ("we", "our", or "us") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (the "DMCA"), we will respond expeditiously to claims of copyright infringement committed on the Mixgens website (www.mixgens.com) if such claims are reported to our designated Copyright Agent as outlined below.

Important Notice Regarding Our Content

Mixgens is a playlist generator tool. We do not host, store, or distribute any audio files (such as MP3s) directly on our servers. All music metadata, track information, album artwork, and audio previews are retrieved dynamically via official third-party Application Programming Interfaces (APIs), such as the Spotify Web API. As such, the underlying content remains the property and responsibility of those third-party platforms and their respective copyright holders.

If you believe that your copyrighted work is being infringed upon via the content displayed on our site through these APIs, we strongly recommend directing your takedown requests directly to the host platform (e.g., Spotify). However, if you believe specific content on the Mixgens website itself infringes your copyright, please follow the procedure below.

How to File a DMCA Notice of Alleged Infringement

If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the Mixgens website by completing a DMCA Notice of Alleged Infringement and delivering it to our designated Copyright Agent.

Upon receipt of a valid notice, we will take whatever action, in our sole discretion, we deem appropriate, including removal of the challenged content from the Mixgens website.

To file a DMCA Notice, please provide the following information in writing:

  1. Identify the Copyrighted Work: A description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identify the Infringing Material: A description of the material that you claim is infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., specific URLs on the Mixgens website).
  3. Your Contact Information: Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an email address.
  4. Statement of Good Faith: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Statement of Accuracy: The information in the notification is accurate, and under penalty of perjury, you are authorized to act for the owner of the allegedly infringed exclusive right.
  6. Signature: Your physical or electronic signature (typing your full legal name is sufficient).

Counter-Notification Procedure

If you believe that material you posted on the site was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us by submitting written notification to our Copyright Agent. Your counter-notice must include:

  1. Identification of the material that has been removed and the location (URL) at which the material appeared before it was removed.
  2. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Your name, address, telephone number, and email address.
  4. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside the United States, for any judicial district in which Mixgens may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  5. Your physical or electronic signature.
